AM OPERATING LLC operates https://anatomymapper.com (the “Site”). This Terms and Conditions Agreement, the Privacy Policy, and all policies posted on AM OPERATING LLC’s sites set out the terms for the user (“User”) on which AM OPERATING LLC offers Users access to and use of AM OPERATING LLC’s sites, services, applications and tools (collectively "Services"). All policies are incorporated into this Terms and Conditions Agreement. You agree to comply with all of the Terms and Conditions Agreement, Privacy Policy, and all policies posted on AM OPERATING LLC’s sites when accessing or using AM OPERATING LLC’s Services.
Please be advised that this Terms and Conditions Agreement contains provisions that govern how claims Users and AM OPERATING LLC may have against each other are resolved (see Disclaimer of Warranties and Limitation of Liability and Legal Disputes provisions below).

The Site is a website comprised of various pages that allows Users to access and view AM OPERATING LLC’s visualization and accompanying terms. Users will be required to setup an account (“Site Account”) to view and interact with the Site.
🔷ACCEPTABLE USE POLICY
If you choose to use any of AM OPERATING LLC’s Services, you agree to do so in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in this Agreement and all policies posted on AM OPERATING LLC’s sites.
The Site is provided for your and others' personal, non-commercial interest only in the products, services and general business of AM OPERATING LLC, subject to the terms of these terms and conditions of use and all modifications thereto, and the rules that may be published from time to time by AM OPERATING LLC. You may not sell any Content (as defined in this section below) or other material from the Site for any other purpose. All such uses are strictly prohibited without the express prior written consent of AM OPERATING LLC, which may be given or withheld in AM OPERATING LLC’s discretion. You agree that you will not in any way modify, add to, delete from or tamper with any Content or feature of the Site or interfere in any way with its proper functioning.
This Site is intended to provide users with general information about the products, services and general business condition and operations of AM OPERATING LLC. This Site may be used in the future to purchase products and services of AM OPERATING LLC. The posted information, data, text, photographs, graphics, video, messages or other materials ("Content") may be viewed by you and/or other users of the Site.

🔷USER RULES OF CONDUCT
You agree to the following rules of conduct and agree that violation of this policy or helping others to do so, may result in suspension or termination of your use of the Services:

🔸 User must be human and not a robot, artificial intelligence, cyborg with electronically enabled cognitive or visual capabilities, or other computerized or electronic user. 🔸🔸Interception. Monitoring of data or traffic on a System without permission.
🔸🔸Falsification of Origin. Forging TCP-IP packet headers, e-mail headers, or any part of a message describing its origin or route. The legitimate use of aliases and anonymous remailers is not prohibited by this provision.
🔸User may not use, or encourage, promote, facilitate or instruct others to use, the Services or Site for any illegal, harmful, fraudulent, infringing or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, fraudulent, infringing or offensive. Prohibited activities or content include:
🔸🔸Illegal, Harmful or Fraudulent Activities. Any activities that are illegal, that violate the rights of others, or that may be harmful to others, AM OPERATING LLC’s operations or reputation, including disseminating, promoting or facilitating child pornography, offering or disseminating fraudulent goods, services, schemes, or promotions, make-money-fast schemes, ponzi and pyramid schemes, phishing, or pharming.
🔸🔸Infringing Content. Content that infringes or misappropriates the intellectual property or proprietary rights of others.
🔸🔸Offensive Content. Content that is defamatory, obscene, abusive, invasive of privacy, or otherwise objectionable, including content that constitutes child pornography, relates to bestiality, or depicts non-consensual sex acts.
🔸🔸Harmful Content. Content or other computer technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.
🔸User will not breach or circumvent any laws, third-party rights or AM OPERATING LLC’s systems, policies, or determinations of your Site Account status.
🔸User may not use AM OPERATING LLC’s Services if you are not able to form legally binding contracts, or are temporarily or indefinitely suspended from using AM OPERATING LLC’s sites, services, applications or tools.
🔸User will not transfer the Site Account and user ID to another party without AM OPERATING LLC’s consent.
🔸User will not distribute viruses or any other technologies that may harm AM OPERATING LLC or the interests or property of users.
🔸User will not use any robot, spider, scraper, data mining tools, data gathering and extraction tools, or other automated means to access AM OPERATING LLC’s Services for any purpose.
🔸User will not interfere with the working of AM OPERATING LLC’s Services or impose an unreasonable or disproportionately large load on AM OPERATING LLC’s infrastructure.
🔸User will not infringe the copyright, trademark, patent, publicity, moral, database, trade secret, and/or other intellectual property rights (collectively, "Intellectual Property Rights") that belong to or are licensed to AM OPERATING LLC or a third party. Some, but not all, actions that may constitute infringement are reproducing, performing, displaying, distributing, copying, reverse engineering, decompiling, disassembling, or preparing derivative works from content that belongs to AM OPERATING LLC or any third-party.
🔸User will not infringe any Intellectual Property Rights that belong to third parties affected by your use of the Services.
🔸User will not harvest or otherwise collect information about users without their consent.
🔸User will not circumvent any technical measures AM OPERATING LLC uses to provide the Services.
Failure to comply with the guidelines under this policy may result in termination of your Site Account or other response that AM OPERATING LLC deems necessary and proper.
Further, AM OPERATING LLC reserves the right, in its sole discretion, to terminate your access to the Site and AM OPERATING LLC’s Services or any portion thereof at any time, without notice.

Users may choose to cancel their Site Account at any time by contacting AM OPERATING LLC via email or mail as outlined in the Contact Us section below.

NEITHER AM OPERATING LLC NOR ANY OF ITS AGENTS OR CONTENT PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF ANY AM OPERATING LLC'S SERVICES OR INABILITY TO GAIN ACCESS TO OR USE THE AM OPERATING LLC'S SERVICES OR OUT OF ANY BREACH OF ANY WARRANTY. YOU HEREBY ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT ON THE AM OPERATING LLC'S SERVICES. YOU ACKNOWLEDGE AND AGREE THAT AM OPERATING LLC'S SERVICES UTILIZE PUBLIC NETWORKS AND THIRD-PARTY PRODUCTS AND SERVICES AND THAT AM OPERATING LLC SHALL HAVE NO RESPONSIBILITY OR LIABILITY WHATSOEVER FOR ANY SERVICE INTERRUPTION, MALFUNCTION, LOSS OF DATA, SECURITY BREACH OR OTHER DAMAGE OR HARM THAT MAY BE CAUSED BY SUCH NETWORKS AND THIRD-PARTY PRODUCTS. YOUR SOLE REMEDY IN THE EVENT OF SUCH SERVICE INTERRUPTION, MALFUNCTION, LOSS OF DATA, SECURITY BREACH OR OTHER MALFUNCTION SHALL BE AGAINST THE PROVIDER OF SUCH NETWORK OR OTHER THIRD-PARTY PRODUCT OR SERVICE.
CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
🔷INTELLECTUAL PROPERTY RIGHTS

These Terms and Conditions Agreement permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on AM OPERATING LLC’s Site, except as follows:
🔸 Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
🔸 You may store files that are automatically cached by your Web browser for display enhancement purposes.
🔸 If AM OPERATING LLC provides desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by AM OPERATING LLC’s end user license agreement for such applications.

The Anatomy Mapper® mark, the terms AUGMENTED DOC, NOVEL, COORDINATED, LINGUISTIC GPS, BODY MAPPER, NOVEL MARKS, NOVEL ENGINES, NOVEL FOLDERS, NOVEL BOOKMARKS, MAGIC NOTE WRITER, AI NOTE WRITER, THERE’S A MAP FOR THAT, MAP STORE, SHADOW CHARTS, AUGMENTED DOCUMENTATION, AUGMENTED PAPER , and all related names, logos, product and service names, designs, and slogans are trademarks of AM OPERATING LLC or its affiliates or licensors. You must not use such marks without the prior written permission of AM OPERATING LLC. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.
🔷USER CONTRIBUTIONS
The Site may contain message boards, chat rooms, personal web pages or profiles, forums, bulletin boards, and other interactive features (collectively, "Interactive Services") that allow users to post, submit, publish, display, or transmit to other users or other persons (hereinafter, "post") content or materials (collectively, "User Contributions") on or through the Site.
All User Contributions must comply with the User Rules of Conduct set out in this Terms and Conditions Agreement.
Any User Contribution you post to the site will be considered non-confidential and non-proprietary. By providing any User Contribution on the Site, you grant AM OPERATING LLC and its respective successors and assigns ownership, the right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose.
You represent and warrant that:

AM OPERATING LLC is not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of the Site.
AM OPERATING LLC has the right to remove or refuse to post any User Contributions for any or no reason in AM OPERATING LLC’s sole discretion.

You agree that, except to the extent inconsistent with or preempted by federal law, the laws of the State of Ohio, without regard to principles of conflict of laws, will govern this agreement and any claim or dispute that has arisen or may arise between you and AM OPERATING LLC, except as otherwise stated in this agreement. You further agree and expressly consent to the exercise of personal jurisdiction in the State of Ohio, in connection with any dispute or claim involving the Site. Further, and dispute between User and AM OPERATING LLC shall be resolved by arbitration. Therefore, any dispute shall be settled by arbitration in Lucas County, Ohio, in accordance with the rules of the American Arbitration Association.
🔷CHILDREN
AM OPERATING LLC does not sell products or services to children. If you are under the age of 18, you may use AM OPERATING LLC’s Services only with the involvement and express permission of a parent or guardian. AM OPERATING LLC shall not be liable for or required to refund any payments or credit card charges made by anyone under the age of 18.
